Holidays Act Review
The Holidays Act Taskforce appointed by the Government has released an Issues Paper outlining potential changes to the Holidays Act 2003. The review was initiated following significant non-compliance with the Act, mainly relating to employees on non-standard hours, or variable incomes, having entitlements calculated incorrectly.
The Issues Paper highlights a number of areas in which the current Act can be seen to be deficient. This includes definitions of terms not being provided, potential inconsistencies throughout the Act, and not giving employers enough guidance in respect of what can be complicated calculations. New concepts are also introduced, such as how the ‘Mondayisation’ of public holidays can impact on entitlements.
The Issues Paper is available to view at the MBIE website and submissions on the document close Friday 12th of October.
